\n\t\t\t\t\tTerms and Conditions\n\t\t\t\t<\/h1>\n\t

\n\t\t\t\t\tPARTICIPATION AGREEMENT, RELEASE, AND ACKNOWLEDGEMENT OF RISK\n\t\t\t\t<\/h3>\n\t\t\t

In consideration of the services of Parguera Glassbottom Kayaking, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, I hereby agree to release, indemnify and discharge Parguera Glassbottom Kayaking, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows:<\/p>\n\t

  1. I acknowledge that sea kayaking entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: boat capsize; tidal conditions and currents; travel in remote areas; collision with objects or other watercraft; prolonged exposure to cold water, hypothermia, accidental drowning; mental anguish or trauma, illness in remote areas; adverse weather conditions, exposure to sun, strong wind, cold storms, large waves, eddies and whirlpools, and lightning; aggressive and\/or poisonous marine life; wrist, arm, shoulder, and\/or back injuries; slips and falls while hiking; and rapidly changing weather and water conditions. Furthermore, Parguera Glassbottom Kayaking guides have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant\u2019s fitness or abilities. They might misjudge the weather, the elements, or the terrain. They may give inadequate warnings or instructions, and the equipment being used might malfunction.<\/li>\n
  2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.<\/li>\n
  3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Parguera Glassbottom Kayaking from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of Parguera Glassbottom Kayaking\u2019s equipment or facilities, including any such claims which allege negligent acts or omissions of Parguera Glassbottom Kayaking.<\/li>\n
  4. Should Parguera Glassbottom Kayaking or anyone acting on their behalf, be required to incur attorney\u2019s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.<\/li>\n
  5.   6. In the event that I file a lawsuit against Parguera Glassbottom Kayaking, I agree to do so solely in Puerto Rico, and I further agree that the substantive law of that territory shall apply in that action without regard to the conflict of law rules of that territory. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.<\/li>\n<\/ol>\n

    \n\t\tAUTHORIZATION\n\t<\/h3>\n\t

    I hereby authorize any medical treatment deemed necessary in the event of any injury while participating in the activity. I either have appropriate insurance or, in its absence, agree to pay all costs of rescue and\/or medical services as may be incurred on my\/our behalf. I agree that any film or photographs of me\/us, as participants, become the property of Parguera Glassbottom Kayaking and may be used for promotional or commercial purposes.<\/p>\n

    Las partes reconocen y acuerdan que este formulario de ACUERDO DE PARTICIPACI\u00d3N, LIBERACI\u00d3N Y RECONOCIMIENTO DE RIESGO podr\u00e1 ser ejecutado mediante firma electr\u00f3nica, la cual ser\u00e1 considerada como firma original para todos los efectos y tendr\u00e1 la misma fuerza y efecto que una firma original. Sin limitaci\u00f3n, la \u00abfirma electr\u00f3nica\u00bb incluir\u00e1 versiones enviadas de una firma original o versiones escaneadas y transmitidas electr\u00f3nicamente (por ejemplo, a trav\u00e9s de PDF) de una firma original.<\/p>\n

    I agree to pay a minimum $100 rescue fee in the event that I and\/or the Equipment must be recovered.<\/p>\n

    \n\t\tPARENT'S OR GUARDIANS ADDITIONAL INDEMNIFICATION\n\t<\/h3>\n\t

    Teniendo en cuenta que Parguera Glassbottom Kayaking permite al menor nombrado a continuaci\u00f3n (\u00abMenor\u00bb) participar en sus actividades y utilizar su equipo e instalaciones, adem\u00e1s acepto indemnizar y eximir de responsabilidad a Parguera Glassbottom Kayaking de todos y cada uno de los reclamos presentados por , o en nombre del Menor, y que est\u00e9n de alguna manera relacionados con dicho uso o participaci\u00f3n por parte del Menor.<\/p>","protected":false},"excerpt":{"rendered":"
